Eviction services are often necessary when dealing with problematic renters who refuse to pay rent or violate lease agreements. Here are three ways they'll deal with those pesky renters:
Serve a Notice of Eviction
The first step in eviction is to serve the tenant with a notice of eviction. This notice informs the tenant that they are violating their lease agreement and have a certain amount of time to rectify the situation or vacate the premises. Depending on the state and the type of violation, this notice may give the tenant as little as three days or as much as 30 days to comply.
The notice of eviction is typically served in person or by certified mail. If the tenant fails to comply, the eviction process will continue to the next step.
File for Eviction
If the tenant fails to comply with the eviction notice, the service will file a lawsuit to evict the tenant. The lawsuit is typically filed in the county where the rental property is located.
Eviction services must prove to the court the tenant has violated their lease agreement or failed to pay rent. The evidence may include lease agreements, rent payment records, and correspondence between the landlord and the tenant.
Once the case is filed, the tenant will be served a summons to appear in court, where they can respond to the lawsuit and present their evidence.
If the court rules in favor of the landlord, they will give the tenant a fixed period to vacate the premises. If the tenant fails, the eviction service may be required to obtain a writ of possession from the court.
Obtain a Writ of Possession
When the tenant outright refuses to vacate the property after the court ruling, the eviction service must obtain a writ of possession from the court. This writ allows the eviction service to evict the tenant and their belongings from the property forcibly.
The eviction service will typically hire a sheriff or other law enforcement officer to carry out the eviction. The officer will provide the tenant with a final notice to vacate the property and remove the tenant and their from the premises.
The tenant may be allowed to remove their belongings before eviction occurs. However, if the tenant refuses to cooperate, the eviction service may need to remove and store the belongings until the tenant claims them.
